Descripción The objective of the research that resulted in the article presented here was to determine which assumptions are not attributable to the precautionary nature of pretrial detention. The research method is based on documentary or bibliographic review, conducting a comparative law analysis of the application, in various countries, of assumptions that are not attributable to the precautionary nature of pretrial detention. This documentary and comparative law review began by examining scientific articles and texts by renowned jurists and researchers on the assumptions considered for the application of the precautionary measure: pretrial detention, as well as judgments of the Inter-American Commission on Human Rights regarding cases on assumptions not attributable to the precautionary nature of pretrial detention applied in rulings from various countries. The analysis of the results determined that the assumptions not attributable to the precautionary nature of pretrial detention have been, for the most part, social unrest, frequency, the defendant's criminal record, and the seriousness of the crime. All the authors and legal norms studied from various countries, as well as the reviewed judgments, lead to the conclusion that there are only two conditions legally attributable to the precautionary nature of pretrial detention: periculum in mora or risk of flight and fumus boni iuris or title of good law.
Descripción El objetivo de la investigación que resultó en el artículo que se presenta fue determinar cuáles son los presupuestos que no son atribuibles al carácter cautelar de la prisión provisional. Por otro lado, el  método en que se fundamenta la investigación es documental o de revisión bibliográfica, realizando un análisis jurídico de derecho comparado sobre la aplicación, en diversos países, de presupuestos que no son atribuibles al carácter cautelar de la prisión provisional. Esta revisión documental y de derecho comparado partió del examen de los artículos científicos y textos de reconocidos juristas e investigadores sobre los presupuestos considerados para la aplicación de la medida cautelar: prisión provisional, así como de las sentencias de la Comisión Interamericana de Derechos Humanos relativas a casos sobre presupuestos no atribuibles al carácter cautelar de la prisión provisional aplicados en fallos de diversos países. En el análisis de los resultados se pudo determinar que los presupuestos no atribuibles al carácter cautelar de la prisión provisional han sido, en su gran mayoría: la alarma social, la frecuencia, los antecedentes penales del acusado y la gravedad del delito. Todos los autores y normas legales estudiadas de diversos países, así como las sentencias revisadas llevan a concluir que solo hay dos presupuestos legalmente atribuibles al carácter cautelar de la prisión provisional: periculum in mora o peligro de fuga y fumus boni iuris o título de buen derecho.
