The hypothesis is that the concept of the simple forma validity of the system and the predominance of effectiveness over material validity undermine the application of the Law, and the realization of the Laws objectives. Methods such as dialectical, comparative, analytical and descriptive are used in the work; and with them we reach the conclusion that the use of general principles, fundamental rights and duties enriches and contributes to the best application of Law and Civil Law, and the fulfillment of the Law’s objectives.
Descripción El principal motivo del presente trabajo consiste en encontrar la vía que conduzca a definir y aplicar en el sistema de nuestro Derecho Civil el concepto de la validez material, para mejorar su funcionamiento mediante los principios generales, así como los derechos y deberes fundamentales.
La hipótesis consiste en que el concepto de la simple validez formal del sistema y el de predominio de la eficacia sobre la validez material menoscaban la aplicación del Derecho.
En el trabajo se usan métodos como el dialéctico, el comparativo, el analítico y el descriptivo; y con ellos se llega a la conclusión de que el uso de principios generales, derechos y deberes fundamentales enriquece y coadyuva a la mejor aplicación del Derecho y del Derecho Civil.
