Descripción Argentina has been condemned five times by the Inter-American Court of Human Rights for delays in issuing judicial rulings within a reasonable time and the resulting denial of justice. In two of these cases, the delays were attributable to judicial bodies in the province of Buenos Aires. This analysis examines these two Inter-American Court rulings, comparing them with the current state of the civil and commercial courts and the labor courts, based on statistical data from the Federal Board of Courts and Superior Courts of Justice of the Argentine Provinces and the Autonomous City of Buenos Aires (JUFEJUS) and the Supreme Court of the Province of Buenos Aires (SCJBA). For the first ruling, the period analyzed is from 2013 to 2021, while for the second, it is from 2017 to 2021. We conclude that in the civil and commercial courts, the difference between the number of cases filed and those resolved annually is enormous, resulting in a significant backlog of cases. In the years before the electronic case file system was implemented (2013, 2014, and 2015), more cases were resolved than in subsequent years. Since 2017, there has been an increase in the resolution of cases, which then declined until 2021. The situation differs in labor courts, where the workload is lower. Thus, there was an increase in the number of cases resolved annually, which began rising in 2013 and decreased due to the pandemic, before recovering in 2021 with figures very close to pre-pandemic levels.
Descripción Argentina fue condenada en cinco ocasiones por la Corte Interamericana de Derechos Humanos (en adelante, Corte IDH) por la demora en la emisión de un pronunciamiento judicial en un plazo razonable y la consecuente denegación de justicia. En dos de ellas, la demora resultó atribuible a organismos judiciales bonaerenses. En efecto, se analizan estas dos condenas de la Corte IDH, cotejándolo con el panorama actual de los fueros civil y comercial, y laboral, según la base de datos estadística de la Junta Federal de Cortes y Superiores Tribunales de Justicia de las Provincias Argentinas y la Ciudad de Buenos Aires (JUFEJUS) y de la Suprema Corte de Justicia de la Provincia de Buenos Aires (SCJBA). En relación  con la primera, tomamos como periodo de tiempo analizado desde el 2013 hasta el 2021, mientras que para la segunda desde el 2017 hasta el 2021. En conclusión, se observa que en el fuero civil y comercial existe una marcada diferencia entre la cantidad de causas que ingresan y las que resuelven anualmente, lo que se traduce en una acumulación significativa de expedientes. Los años en los que no se había incorporado el expediente electrónico (2013, 2014 y 2015) se resolvieron más causas que en los posteriores. Desde el 2017 se halla un incremento en la resolución de expedientes, que luego va en descenso hasta el 2021. La cuestión difiere en el fuero laboral en el que el índice de congestión de trabajo es menor. Así pues, se produjo un aumento en la cantidad de causas resueltas anualmente que va en ascenso desde el 2013, y que menguó con motivo de la pandemia, para volver a restablecerse en el 2021 con cifras muy cercanas a los años prepandémicos.
