Descripción The sports contract is a fundamental instrument in the field of professional sports. This type of contract regulates the relationship between athletes and sports entities, establishing rights and obligations that must be fulfilled by both parties; In most legislations this contract is eminently private in nature, however, other international regulations have contemplated a different protection and legal framework to regulate what is considered a special employment relationship. In light of labor law, the sports contract has particular characteristics that differentiate it from other employment contracts. The importance of examining the legal implications of the sports contract, analyzing its nature, its particularities and its regulation in the context of labor law in Panama and carrying out objective analysis in comparative law has been fundamental in the creation of legal viability and factual necessity in our sports scenario.
Descripción El contrato deportivo es un instrumento fundamental en el ámbito del deporte profesional. Este tipo de contrato regula la relación entre los deportistas y las entidades deportivas, estableciendo derechos y obligaciones que deben ser cumplidos por ambas partes; en la mayoría de las legislaciones este contrato es de naturaleza privada, sin embargo, otras normativas internacionales han contemplado una protección y marco jurídico diferente para regular lo que se considera una relación especial de trabajo. A la luz del derecho laboral, el contrato deportivo presenta características particulares que lo diferencian de otros contratos laborales. La importancia de examinar las implicaciones legales del contrato deportivo, analizando su naturaleza, sus particularidades y su regulación en el contexto del Derecho Laboral en Panamá y realizar análisis objetivo en el derecho comparado ha sido fundamental en la creación de la viabilidad jurídica y la necesidad fáctica en nuestro escenario deportivo y jurídico.
