This work contemplates a new perspective about the undue exercise of the right, in order to obtain specific parameters and, with an objective direction, to ease the configuration of the elements of that one. Such elements regardless of its consequences, are: overreach in the exercise of the right and harm to a legitimate interest. Descripción
Este trabajo contempla una nueva perspectiva sobre el abuso del derecho con el fin de obtener parámetros específicos y, con una dirección objetiva, facilitar la configuración de los elementos de aquél.
Tales elementos, independientemente de sus consecuencias, son: la extralimitación en el ejercicio del derecho y el agravio a un interés legítimo.
