Although it is a classic theme, at present, in many cases the confusion between the notion of mandate and the concept of representation persists, giving them an indistinct treatment, a difficulty that probably has its cause, in the absence of a current regulation that highlights the particularities of both legal institutions.
Descripción El presente estudio se centra en ofrecer un análisis acerca del valor práctico jurídico que para el Derecho privado contractual moderno, reviste la distinción entre la figura del mandato y la representación.
Si bien se trata de un tema clásico, en la actualidad, en muchas ocasiones persiste la confusión entre la noción de mandato y el concepto de representación brindándoles un tratamiento indistinto, dificultad esta que probablemente tenga su causa, en la carencia de una regulación normativa vigente que destaque las particularidades de ambas instituciones jurídicas.
