Descripción Almost three years after the implementation of the Special Jurisdiction forIntegrity and Transparency, we are dedicated to objectively analyzing the resultsand challenges encountered in disciplinary matters, pursuant to Law 53 of August27, 2015, which regulates Judicial Career and created the jurisdiction. Exposingits shortcomings will lead us to identify the legal reforms necessary to strengthenand improve the jurisdiction.Therefore, we will sometimes analyze the lack or absence of regulationsfor certain situations, and at other times, the need to introduce reforms to thecurrent regulations. It is also important to remember that the true autonomy ofdisciplinary law depends on the existence of a Disciplinary Code.
Descripción A casi tres años de haber sido implementada la Jurisdicción Especial de Integridady Transparencia, nos abocamos a analizar de manera objetiva los desafíos surtidosen materia disciplinaria, en virtud de la aplicación de la Ley 53 de 27 de agosto de2015, por la cual se regula la Carrera Judicial, y a su vez creó dicha jurisdicción.Visibilizar sus falencias, nos conducirán a identificar las reformas legales necesariaspara el fortalecimiento y mejora de la jurisdicción.Es por ello que en algunas ocasiones analizaremos la falta o ausencia de normativapara determinadas situaciones y en otras, la necesidad de introducir una reforma, a lanorma actual. Sin dejar de lado, que la verdadera autonomía del derecho disciplinariopende de la existencia de un Código Disciplinario.
