Descripción This article addresses the concept of the writ for judicial independence in Panama,understood as a necessary guarantee and protection for judges and magistratesin the performance of their duties. This concept is examined in the context ofthe guarantee of freedom of expression, which is also a necessary guarantee in ademocratic state under the rule of law. The constitutional and legal foundationsfor exercising both guarantees without detriment to one another are analyzed,explaining their importance and their contribution to society. The arguaranteesdiesthe application of the legal provision that supports the mechanism of the amparo forjudicial independence, its prerequisites, and the scenario in which the guaranteesof judicial independence and freedom of expression are in confrontation.
Descripción El presente artículo aborda la figura del amparo a la independencia judicial enPanamá, entendida esta como garantía y necesaria protección para la función dejueces y magistrados en el ejercicio de sus funciones, enfrentada al ejercicio de lagarantía correspondiente a la libertad de expresión, garantía también necesaria enun Estado democrático de derecho. Se analizan las bases constitucionales y legalespara el ejercicio de ambas garantías, sin el menoscabo de la otra, explicándose laimportancia de estas y su contribución dentro de la sociedad. También se estudia laaplicación de la norma que sustenta el mecanismo del amparo a la independenciajudicial, sus presupuestos y el escenario en que las garantías de la independenciajudicial y la libertad de expresión quedan confrontadas.
