Descripción This article analyzes the influence of Montesquieu and Rousseau on the historical and contemporary development of the Peruvian legal system. The central objective is to identify how the Enlightenment ideas of both philosophers have shaped fundamental principles of the legal system in Peru. The study begins with a documentary review and comparative analysis of constitutional texts, philosophical doctrines, and Peruvian legal regulations from the 19th century to the present. It examines the impact of the principle of separation of powers and the rule of law, inherited from Montesquieu, as well as Rousseau's notions of the general will and the social contract. The results reveal a significant presence of these concepts in the country's constitutional structure, especially in the configuration of public power, the promotion of citizen rights, and civic education. It also identifies current tensions, such as institutional instability, the concentration of power, and weak citizen participation, which contrast with the founding ideals of both thinkers. Through this study, it is argued that the consolidation of the legal system requires a critical review of these philosophical influences. In conclusion, the article argues that the ideas of Montesquieu and Rousseau were not only fundamental to the formation of the Peruvian state, but also remain key to promoting a more democratic, participatory, and just legal model.
Descripción Este artículo analiza la influencia de Montesquieu y Rousseau en el desarrollo histórico y contemporáneo del sistema jurídico peruano. El propósito central es identificar cómo las ideas ilustradas de ambos filósofos han modelado principios fundamentales del ordenamiento legal en el Perú. El estudio parte de una revisión documental y análisis comparativo de textos constitucionales, doctrinas filosóficas y normativas jurídicas peruanas desde el siglo XIX hasta la actualidad. Se examina el impacto del principio de separación de poderes y el Estado de derecho, heredados de Montesquieu, así como las nociones de voluntad general y contrato social, propias de Rousseau. Los resultados revelan una presencia significativa de estos conceptos en la estructura constitucional del país, especialmente en la configuración del poder público, la promoción de derechos ciudadanos y la educación cívica. Asimismo, se identifican tensiones actuales, como la inestabilidad institucional, la concentración de poder y la débil participación ciudadana, que contrastan con los ideales fundacionales de ambos pensadores. A través del estudio, se argumenta que la consolidación del sistema legal requiere una revisión crítica de estas influencias filosóficas. En conclusión, el artículo sostiene que las ideas de Montesquieu y Rousseau no solo fueron fundamentales en la formación del Estado peruano, sino que siguen siendo claves para impulsar un modelo jurídico más democrático, participativo y justo.
