Descripción The principle of interculturality has been present in international treaties ratified by Costa Rica for several decades, but it is until recent times that it has begun to have the importance and respect it deserves. And with the constitutional reform of 2015, which recognizes that we are a multi-ethnic and multicultural country, the importance of dimensioning its link with normative sources and indigenous customary law is further highlighted. The paradigm on the basis of which custom was analyzed and valued as an unwritten source of the Costa Rican legal system also changes. Cultural expertise turns out to be a fundamental tool for its proper application.
Descripción El principio de interculturalidad está presente en tratados internacionales ratificados por Costa Rica desde hace varias décadas, pero es hasta épocas recientes que ha empezado a tener la importancia y respeto que amerita. Con la reforma constitucional del 2015, que reconoce expresamente es Costa Rica una nación multiétnica y pluricultural, se resalta aún más la importancia de dimensionar su vínculo con las fuentes normativas y el Derecho consuetudinario indígena. También cambia el paradigma con base en el cual se analizaba y asignaba valor a la costumbre como fuente no escrita del ordenamiento jurídico costarricense. El peritaje cultural resulta ser una herramienta fundamental para su debida aplicación.
