For this reason, this essay is innovative, as it was written before the new model for the administration of civil justice came into force, that is, before the procedural stages had yet been implemented. It therefore serves as a reference reading for judges and magistrates, judicial officials, prosecutors, litigating attorneys, and civil procedural law scholars.
The main axis of this analysis is the role of the judge as in charge of giving direction to the civil process, and we will make a comparison with the previous system, governed by the provisions of the Judicial Code (1984)
The problem is that judges and magistrates must adjust to a new civil procedure. This change entails abandoning the culture of writing and opting for orality, promoting hearing acts and the application of conventional, constitutional and legal norms in civil procedure in Panama.
Continuous and specialized training will be the key response to face the challenges of all the problems that arise in the management of civil proceedings.
In conclusion, the new Civil Procedure Code symbolizes a significant advance towards a contemporary and efficient justice administration model in civil jurisdiction. This reform demonstrates the commitment of the Judicial Branch of Panama to improve the quality and duration of civil processes, for the benefit of citizens and the strengthening of the rule of law.
Descripción El artículo tiene relación con la implementación del Código Procesal Civil (CPC) en Panamá, que es el novedoso sistema de gestión de justicia en la jurisdicción civil que regirá en el país desde el 11 de octubre de 2025. Esta serie de reglamentos reemplazarán las estipulaciones del Libro Segundo del Código Judicial, señalando una transición hacia un modelo más actualizado y eficiente.
Por tal motivo, este ensayo resulta innovador, ya que se hace antes de la entrada en vigencia del nuevo modelo de administración de justicia civil, es decir, cuando aun no se han puesto en marcha los estadios procesales, y por ende sirve como una lectura de referencia para los jueces y magistrados, servidores judiciales, fiscales, abogados litigantes, y académicos del derecho procesal civil.
El eje principal de este análisis es el rol del juez como encargado de dar dirección al proceso civil, y haremos una comparación con el sistema anterior, regido por las disposiciones del Código Judicial (1984).
El problema consiste en que los jueces y magistrados deben ajustarse a un nuevo procedimiento civil. Este cambio conlleva abandonar la cultura de la escritura y optar por la oralidad, al fomento de actos de audiencia y la aplicación de normas convencionales, constitucionales y jurídicas en el procedimiento civil de Panamá.
La formación continua y especializada será la respuesta clave para enfrentar los retos a todos los problemas que surjan en la gestión del proceso civil.
En conclusión, el nuevo Código Procesal Civil simboliza un avance significativo hacia un modelo de administración de justicia contemporáneo y eficiente en la jurisdicción civil. Esta reforma evidencia el compromiso del Órgano Judicial de Panamá a mejorar la calidad y la duración de los procesos civiles, en beneficio de los ciudadanos y el fortalecimiento del Estado de Derecho.
