Descripción The budgetary allocation is the instrument that allows to establish the most equitable distribution and tries to allocate the available national resources through short- and long-term strategic plans to contribute to the general welfare. This paper addresses the relationship between the budget and some variables of the administration of justice, as well as an approach with the Gross Domestic Product (GDP) to understand the impact of the Panamanian judicial system on economic growth. For this, a non-experimental research design is carried out, since no control was performed on the variables under study and the facts were observed as they appeared for the period 2012-2022, with a quantitative, descriptive, correlational and longitudinal approach. The objective of this work is to examine in which extent the budgetary allocation affects the results of the administration of justice through the use of independent variables such as the Legal Budget designated to the Judicial Body, percentage of public spending allocated to the Judicial Branch, budget of the Judicial Branch per inhabitant; and as dependent variables are the indicators of results such as hearings held, pending cases at the end of each period, average response time (in years), the pendency or cases to be resolved at the end of the period, the congestion rate, the decongestion rate and the resolution rate. At the end of the statistical analysis, it was established that if the budget allocated to the Judicial Branch increases, two effects occur: the hearings held increase and, therefore, there is a positive relationship; and there is an inverse relationship with the workload and pending cases because they decrease. For this reason, budgetary allocations affect the results of justice management, improving its efficiency and productivity, and contributing to an increase in GDP.
Descripción La asignación presupuestaria es el instrumento que permite establecer la distribución más equitativa e intenta asignar los recursos nacionales disponibles mediante planes estratégicos a corto y largo plazo para contribuir al bienestar general. Este trabajo aborda la relación entre el presupuesto y algunas variables de la administración de justicia, así como un acercamiento con el Producto Interno Bruto (PIB) para comprender el impacto del sistema judicial panameño en el crecimiento económico. Para esto, se realiza un diseño de investigación no experimental, ya que no se realizó control sobre las variables objeto de estudio y se observaron los hechos tal como se manifestaron para el período 2012-2022, con un enfoque cuantitativo, descriptivo, correlacional y longitudinal. El objetivo del trabajo consiste en examinar en qué medida la asignación presupuestaria incide en los resultados de la administración de justicia mediante el uso de variables independientes, tales como el Presupuesto Ley designado al Órgano Judicial, el porcentaje del gasto público destinado al Órgano Judicial, el presupuesto del Órgano Judicial por habitante; y como variables dependientes se pueden considerar los indicadores de resultados tales como audiencias realizadas, los casos pendientes al culminar cada período, tiempo promedio de respuesta (en años), la pendencia o casos por resolver al culminar el período, la tasa de congestión, la tasa de descongestión y la tasa de resolución. Al concluir el análisis estadístico, se estableció que, si aumenta el presupuesto asignado al Órgano Judicial, se producen dos efectos: las audiencias realizadas aumentan y, por tanto, existe una relación positiva; y hay una relación inversa con la carga laboral y los casos pendientes, porque estos disminuyen. Por consiguiente, las asignaciones presupuestarias inciden en los resultados de la gestión de justicia, mejorando su eficiencia y productividad, y contribuyendo al incremento del PIB.
