Descripción The text analyzes the difficulties in the criminal prosecution of the crime of trafficking in persons for the purpose of sexual exploitation with a transnational dimension, based on the analysis of the "Club El Mirador" court case, which took place in the Federal Courts of Argentina. In this process, the members of a criminal organization that recruited vulnerable young women in Argentina to be sexually exploited in Spain were investigated and punished. The text analyzes the problems that arose in the investigation of the case, cooperation between the two countries and how they were solved. It concludes that it is necessary to strengthen the instruments of international criminal cooperation in the prosecution of this crime and suggests tools and regulatory reforms that can facilitate similar investigations in the future.
Descripción El presente artículo analiza las dificultades que presenta la persecución penal del delito de trata de seres humanos con fines de explotación sexual de carácter transnacional, partiendo del análisis del caso judicial Club el Mirador que se tramitó en los Tribunales Federales de Argentina. En este proceso se investigó y condenó penalmente a los integrantes de una organización criminal que reclutaba a mujeres vulnerables en Argentina para ser explotadas sexualmente en España. Se analiza cuáles fueron las problemáticas que se plantearon en la investigación del caso, la cooperación entre ambos países y cómo se resolvieron. Se concluye la necesidad de reforzar la cooperación penal internacional en la persecución de este delito y se proponen herramientas y reformas normativas que faciliten investigaciones similares en el futuro.
