Descripción Irregular migration can be considered as a consequence of the inconsistency between the social, economic and political conditions in some countries; it is usually related to the ability or willingness of governments to establish legal channels to mitigate irregular migration. In Panama, irregular migration has increased notably in recent years. In this sense, a study carried out by the National Migration Service (SNM, 2023) concludes that during the year 2022, 248,284 irregular migrants were registered in Panama, an unprecedented figure compared to the year 2021. Of the total population of irregular migrants in 2022, 150,327 were of Venezuelan nationality; 29,399 were from the Republic of Ecuador, 22,392 from the Republic of Haiti; 5,961 from the Republic of Cuba; 5,064 Colombians, 4,091 Hindustanis, 2,465 Dominicans and 28,585 irregular migrants of other nationalities. By 2023, the irregular transit of foreigners across the border with Colombia by country, according to order of importance, was occupied until April 30 by Venezuela (55,590 migrants), Haiti (28,610 migrants), Ecuador (16,992 migrants), China ( 5,531) and Colombia (3,835 migrants). This reality generates an optimal scenario for a scientific analysis. This article addresses the challenges of irregular migration, from a theoretical perspective, describing the existing legal framework in Panama regarding migration and the advances on migration policies in the isthmian territory.
Descripción La migración irregular puede considerarse como una consecuencia de la incongruencia entre las condiciones sociales, económicas y políticas en algunos países; suele relacionarse con la capacidad o la voluntad de los gobiernos para establecer los canales legales que mitiguen dicho tipo de migración. En Panamá, la migración irregular se ha incrementado notablemente en los últimos años. En este sentido, un estudio realizado por el Servicio Nacional de Migración (SNM, 2023) concluye que durante el año 2022 se registraron 248,284 migrantes irregulares en Panamá, una cifra sin precedente en comparación con el año 2021. De la población total de migrantes irregulares en el 2022, 150,327 eran de nacionalidad venezolana; 29,399 eran provenientes de la República de Ecuador, 22,392 de la República de Haití; 5,961 de la República de Cuba; 5,064 colombianos, 4,091 indostanes, 2,465 dominicanos y 28,585 migrantes irregulares de otras nacionalidades. Para el 2023, el tránsito irregular de extranjeros por la frontera con Colombia por país, según orden de importancia, lo ocuparon hasta el 30 de abril, Venezuela (55,590 migrantes), Haití (28610 migrantes), Ecuador (16,992 migrantes), China (5,531) y Colombia (3,835 migrantes). Esta realidad genera un escenario óptimo para un análisis científico. Este artículo aborda los desafíos de la migración irregular, desde una perspectiva teórica, describiendo el marco legal existente en Panamá en materia de migración y los avances sobre las políticas migratorias en el territorio istmeño.
