In this article, the most relevant aspects of the role of the mediator in the management of criminal conflicts are developed, since the mediator is a professional whose performance ensures that the victim as well as the perpetrator can collaboratively negotiate an agreement that is satisfactory for both, which brings as a consequence the construction of a culture of peace. At the same time, it should be noted that the conflict is perceived by many people with a negative approach and when that disagreement between two or more people is prosecuted because it is configured in a crime, the panorama worsens. However, when the criminal case is referred to mediation, the mediator takes action to transform the situation into a more positive, cordial and peaceful environment. Therefore, the mediator must have the necessary skills to manage a criminal conflict. In short, it was concluded, among other ideas, that the success of criminal mediation depends to a large extent on the role of the mediator in the effective management of the conflict, for which the positive numbers must also be considered in terms of the data statistics of the Judicial Branch that for the first semester of the year 2021 highlights in the first place the sessions of the accusatory criminal system with respect to the other jurisdictions. En este artículo se desarrollan los aspectos más relevantes del rol del mediador en la gestión de conflictos penales, ya que el mediador es un profesional cuyo desempeño procura que víctima como victimario, puedan negociar de manera colaborativa un acuerdo que sea satisfactorio para ambos, lo que trae como consecuencia la construcción de una cultura de paz. A su vez, se debe indicar que el conflicto es percibido por muchas personas con un enfoque negativo y cuando esa desavenencia entre dos o más personas se judicializa porque se configura en un delito, se agrava el panorama. Sin embargo, cuando se deriva la causa penal a mediación entra en acción el mediador para transformar esa situación en un ambiente más positivo, cordial y pacífico. Por ende, el mediador debe contar con las competencias necesarias para gestionar un conflicto penal. En fin, se llegó a la conclusión, entre otras ideas, que el éxito de la mediación penal depende en gran medida del rol del mediador en la gestión efectiva del conflicto, por lo que también hay que considerar los números positivos en cuanto a los datos estadísticos del Órgano Judicial que para el primer semestre del año 2021 destaca en primer lugar las sesiones del sistema penal acusatorio respecto a las otras jurisdicciones.
