Restorative Justice objective´s so that the Process does not culminate with the imposition of a sanction, instead, it searches for the repair of the damage is sought. Generally, when talking about this concept, people focus on Criminal Law, however, the Panamanian Labor Legislation has been innovative in offering the working-class tools that ensure the protection of their Rights and, above all, the reparation and compensation that assists the worker as a result of the employment relationship, regardless of the cause of termination. In this study, we will address the ways in which the Labor Process becomes a Restorative Justice tool to restore peace and foster harmony in work relationships. Descripción
La Justicia Restaurativa tiende a que el Proceso no culmine con la imposición de una sanción, en cambio, persigue la reparación del daño. Generalmente, al hablar de este concepto, las personas se enfocan en el Derecho Penal, sin embargo, la legislación panameña en materia laboral, ha sido innovadora al ofrecerle a la clase trabajadora, herramientas que aseguren la protección de sus Derechos y, sobre todo, la reparación e indemnización que le asiste al trabajador producto de la relación laboral, sin importar cuál sea la causa de su terminación. En este estudio, abordaremos las formas en que el Proceso Laboral se convierte en una herramienta de la Justicia Restaurativa para reestablecer la paz y fomentar la armonía en las relaciones de trabajo.
