The purpose of this article is to know the constitutional and legislative evolution of the maternity jurisdiction and the jurisprudence of the Supreme Court of Justice, as a result of the interpretation of the norms that regulate this legal figure. Its importance is evident, because protection against employment discrimination on the grounds of maternity is essential for achieving genuine equality of opportunity and treatment for men and women at work, and it is imperative to know the jurisprudential criteria that have given content to this legal figure when deciding the causes that are the object of actions for protection of constitutional guarantees and contentious-administrative appeals and labor cassation. El propósito de este artículo es conocer la evolución constitucional y legislativa del fuero de maternidad y la jurisprudencia de Corte Suprema de Justicia, resultado de la interpretación de las normas que regulan esta figura jurídica. Su importancia es evidente, porque la protección contra la discriminación laboral por razón de la maternidad es esencial para la consecución de una genuina igualdad de oportunidades y de trato para hombres y mujeres en el trabajo, siendo imperativo conocer los criterios jurisprudenciales que han dotado de contenido a esta figura jurídica al decidir las causas objeto de acciones de amparos de garantías constitucionales y recursos contencioso administrativo y de casación laboral.
